By accessing or using GradeWatch ("the Service"), operated by GradeWatch ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of the Service

GradeWatch is a grade-tracking platform that connects to school student information systems (such as StudentVUE / Synergy) to provide parents and guardians with grade dashboards, trend charts, alerts, and AI-powered insights about their children's academic performance.

3. Eligibility

You must be at least 18 years old and the parent or legal guardian of any student whose data you access through the Service. By using GradeWatch, you represent that you have the legal authority to consent to the collection and processing of your child's educational data.

4. Accounts & Authentication

You are responsible for maintaining the confidentiality of your account credentials, including the email address used for magic-link sign-in. You agree to notify us immediately of any unauthorized use of your account.

5. Student Portal Credentials

To sync grades, you provide credentials for third-party student information systems. These credentials are encrypted at rest and used solely to fetch grade data on your behalf. We do not share these credentials with any third party. You are responsible for ensuring you are authorized to use those credentials.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to access data of students for whom you are not the legal guardian.
• Reverse-engineer, scrape, or interfere with the Service's infrastructure.
• Resell or redistribute data obtained through the Service.

7. Subscription & Billing

Paid plans are billed annually through our payment provider (Lemon Squeezy). Prices are listed on our website and may change with 30 days' notice. We offer a 30-day money-back guarantee on new subscriptions. Refund requests after this period are handled at our discretion.

8. Intellectual Property

All content, trademarks, and software comprising the Service are owned by GradeWatch or its licensors. You retain ownership of any data you provide. By using the Service, you grant us a limited license to process your data solely to provide and improve the Service.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available." We make no warranties, express or implied, regarding accuracy, reliability, or availability. Grade data is sourced from third-party portals and may be delayed or incomplete.

10. Limitation of Liability

To the fullest extent permitted by law, GradeWatch shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of your use of or inability to use the Service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

11. Termination

We may suspend or terminate your access at any time for violation of these Terms. You may cancel your account at any time through the dashboard settings. Upon termination, your data will be deleted within 30 days.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or a notice on the Service. Continued use after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Kansas, United States, without regard to conflict of law principles.

14. Severability

If any provision of these Terms is held to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid or unenforceable provision shall be modified to the minimum extent necessary to make it valid and enforceable.
